Unified ECM Inc. Sued Facebook For Unfair Advertising Practices!

The famous social networking website sued for unfair advertising practices. Unified ECM Inc. claims Facebook for overcharging the advertisers for ad space on Facebook’s website. The lawsuit was filed on July 28, 2009. Based on the report by Daily Herald, the lawsuit claims Facebook over charges advertisers based on the reported number of consumers who view the ads on a daily basis.

Unified ECM Inc. had only two options to choose from Facebook when buying advertising space as they were advertising on Facebook. They were required to pay a pre-determined amount each time a Facebook user clicks on their ad, or pay a specified amount for every 1,000 page views, or impressions of the specific ad. The marketing lawsuit is seeking class action status, or group status, which states they were “wrongfully charged for non-existent, fraudulent or invalid clicks."

According to Wikipedia's Facebook page, which is owned under Facebook, Inc., which has a reported 250 million users worldwide. In February 2009, a Compete.com study ranked Facebook as the most used social networking site by worldwide active users, MySpace followed in second place.

Easy ways to save money

Always over estimate your expenses and under estimate your income. Set savings goals, both short term and long term. Think about future, figure out how investments help you in future. First, clear all your debts. Calculate your debts and try to clear in easy installments.

Make a time frame to achieve your goals. Set a target to accomplish a short goal and make sure that you achieve it. Figure out how much you will save per week and for every thing you want to buy.

Always keep a record of your expenses. Write down every thing you have spend your money on, do not leave small purchases. This gives you clear idea and can restrict the unnecessary expenses. Check whether you have saved enough for your short and long-term goals.

Never use credit cards. Pay everything using cash or demand drafts. Do not even use checks, as you may not know how much balance is left in the account. You cannot stop your temptations when you have a credit card. The interest rates and other charges for using the credit cards are huge.

If you get unexpected amount set it aside and focus on your saving plans. Open a savings account and put your money in that. You will also get interest for that.

Always shop with a predetermined shopping list.

No sick leaves please!

The sick leaves served as a good factor for the employers to easily shortlist the list of job cuts. So the more sick leaves the employee takes, the more he is likely to be in the pink slip list of the company. This made employees to turn out to the office even in sickness. I don’t know how they made it. I could have never been able to do that.

It was even found in a survey. It said that the HR professionals of many companies have considered the number of sick leaves as a key factor for lay offs. Other factors included disciplinary records and performance assessment.

This might have been a good strategy where companies didn’t require to lay off people obligatorily. But these days, companies are too often into lay offs due to recession. And it is serious to consider sick leaves as a factor for redundancies even now. It simply destroys career of a person.

The $380m Scam Lawyer Argues for Bail

What is the best thing about being a prominent lawyer in the society? You can fraud people for millions of dollars and still argue for a bail though they have good evidences against you.

It is what Marc Drier did. He was a well-known lawyer of New York City. He had a big and reputed office with around 200 lawyers working in it. He somehow got a chance to do one of the well-known Ponzi Schemes and it was so successful that to got him revenues worth $380 million. And finally people caught him and thus he was convicted under fraud case in Manhattan.

He was seen arguing to be given a bail. And the argument he used for that is so simple (or silly) that I don’t know whether to consider it as an argument of a great lawyer or an argument of a school-boy. It said that he can be given a bail because he doesn’t have much relation with any foreign people and thus he has no opportunity to flee from the country.

Michelle Obama Dress Became Famous In One Night

In June, Michelle Obama, the wife of Democratic Presidential candidate Barack Obama took a turn as co-host of TV talkfest “The View.” She wore a black-and-white, high-waisted print dress designed by Ricco, the audience were so pleased by the dress design everyone wanted similar dress. In overnight, all pieces of the dress were sold out for an affordable price of $148 and Michelle became more popular.

The designer of the dress was very happy and surprised with the sales and recognition she got from that particular dress. It was a coincidence for the designer because she was a fashion designer from long time. She thanked Michelle for wearing that particular dress for the TV show. The dress was identified and named as Michelle’s dress.

The designer and Michelle become more popular with a single dress. Many of my friends purchased the dress and everyone was happy. After appearing in this dress as co-host for a TV show, Michelle has received many invitations as co-host for TV shows.

Even Packaged Water Is Not Free From Contaminants

We have lots of water on earth, as much as 1,460 teratonnes with covering around 71% of earth’s surface. I wonder about this every time when I am buying bottled water. If Earth has so much of water it is good for earth and all its inhabitants, of course including me. If I go to a big water body and have a glass of water from it I am sure I am going to fall sick for the next day. Even our tap water these days doesn’t seem to be safer with all those new germs evolving with new diseases. And we started using our water filters and some machines for filtering. But we cannot carry those water filters along with us every where with us. It looks absurd if I go on a scuba diving with my water filter.

And now enters the packaged drinking water with all hype that it is safest and purest to use. And we believed them and have started buying them with many dollars. And still I don’t get uncontaminated pure water as they advertise. So on whom will I rely on for water the next time I am going out?

South American Ants Ruin Football Game

They may look small, but they are so powerful that they could win over a football team without even playing. No, they are not team of super players. They are a big gang of pests coming all the way from South America to this Southern Californian School and setting up colonies on the field. Now who dares to face the fire ants and ask them to move away? The school faced the same problem. They could do nothing about them and just cancelled the scheduled football match. These ants were discovered by a groundskeeper last week. These venomous red pests have set up several mound-like colonies on school’s football and baseball fields. The state department of Agriculture was consulted immediately. They could not figure it out on how they could travel and reach there. Probably no airlines or railways would dare to give them a lift. Must be some player on the underdog side of the football team have imported them. But entomologists say that this should be treated seriously.

Liquidity Crisis

A "liquidity crisis" occurs when a business experiences a lack of cash necessary to grow the business, pay for day-to-day operations, or meet its debt obligations when they are due. Multiple intelligences

Multiple Intelligences, is an educational theory, first developed by psychologist Howard Gardner, that describes an array of different kinds of "intelligences" exhibited by human beings. Gardner suggests that each individual manifests varying levels of these different intelligences, and thus each person has a unique "cognitive profile." The theory was first laid out in Gardner's 1983 book, Frames of Mind: The Theory of Multiple Intelligences, and has been further refined in subsequent years.

The theory was proposed in the context of debates about the concept of intelligence, and whether methods that claim to measure intelligence are truly scientific. Gardner's theory argues that intelligence, as it is traditionally defined, does not adequately encompass the wide variety of abilities humans display. In his conception, a child who masters the multiplication table easily is not necessarily more intelligent overall than a child who struggles to do so. The second child may be stronger in another kind of intelligence, and therefore may best learn the given material through a different approach, may excel in a field outside of mathematics, or may even be looking through the multiplication learning process at a fundamentally deeper level that hides a potentially higher mathematical intelligence than in the one who memorizes the concept easily. The theory suggests that, rather than relying on a uniform curriculum, schools should offer "individual-centered education", with curriculum tailored to the needs of each child.

Gardner identifies kinds of intelligences based upon eight criteria. His eight criteria for describing something as an independent kind of intelligence (rather than merely one of the skills or abilities included in a kind of intelligence, or a synonym for, or combination of other kinds of intelligence) include:
  • Case studies of individuals exhibiting unusual talents in a given field (child prodigies, autistic savants);
  • Neurological evidence for areas of the brain that are specialized for particular capacities (often including studies of people who have suffered brain damage affecting a specific capacity);
  • The evolutionary relevance of the various capacities;
  • Psychometric studies; and
  • The existence of a symbolic notation (e.g. written language, musical notation, choreography).
Gardner originally identified seven core intelligences: linguistic, logical-mathematical, spatial, bodily-kinesthetic, musical, interpersonal and interpersonal. In 1999 he added an eighth, the naturalistic intelligence, and indicated that investigation continues on whether there is an existential intelligence.

The theory has been widely criticized in the psychology and educational theory communities. The most common criticisms argue that Gardner's theory is based on his own intuition rather than empirical data and that the intelligences are just other names for talents or personality types. Despite these criticisms, the theory has enjoyed a great deal of success amongst educators over the past twenty years. There are several schools, which espouse MI as pedagogy, and many individual teachers who incorporate some or all of the theory into their methodology. Many books and educational materials exist which explain the theory and how it may be applied to the classroom.

Nuclear Warfare Strategy

Nuclear warfare strategy is a way for either fighting or avoiding a nuclear war. The policy of trying to ward off a potential attack by a nuclear weapon from another country by threatening nuclear retaliation is known as the strategy of nuclear deterrence. The goal in deterrence is to always maintain a second strike status (the ability of a country to respond to a nuclear attack with one of its own) and potentially to strive for first strike status (the ability to completely destroy an enemy's nuclear forces before they could retaliate). During the Cold War, policy and military theorists in nuclear-enabled countries worked out models of what sorts of policies could prevent one from ever being attacked by a nuclear weapon.
Different forms of nuclear weapons delivery allow for different types of nuclear strategy, primarily by making it difficult to defend against them and difficult to launch a pre-emptive strike against them. Sometimes this has meant keeping the weapon locations hidden, such as putting them on submarines or train cars whose locations are very hard for an enemy to track, and other times this means burying them in hardened bunkers. Other responses have included attempts to make it seem likely that the country could survive a nuclear attack, by using missile defense (to destroy the missiles before they land) or by means of civil defense (using early warning systems to evacuate citizens to a safe area before an attack). Note that weapons, which are designed to threaten large populations or to generally deter attacks, are known as "strategic" weapons. Weapons, which are designed to be used on battlefield in military situations, are known as "tactical" weapons.
There are critics of the very idea of "nuclear strategy" for waging nuclear war who have suggested that a nuclear war between two nuclear powers would result in mutual annihilation. From this point of view, the significance of nuclear weapons is purely to deter war because any nuclear war would immediately escalate out of mutual distrust and fear, resulting in mutually assured destruction. This threat of national, if not global, destruction has been a strong motivation for anti-nuclear weapons activism.
Critics from the peace movement and within the military establishment have questioned the usefulness of such weapons in the current military climate. The use of (or threat of use of) such weapons would generally be contrary to the rules of international law applicable in armed conflict, according to an advisory opinion issued by the International Court of Justice in 1996.Perhaps the most controversial idea in nuclear strategy is that nuclear proliferation would be desirable. This view argues that unlike conventional weapons nuclear weapons successfully deter all-out war between states, as they did during the Cold War between the U.S. and the Soviet Union. Political scientist Kenneth Waltz is the most prominent advocate of this argument.

The University Of Washington Michael G. Foster School Of Business is the business school at the University of Washington, Seattle. It was founded in 1917 and has nearly 46,000 alumni. The School is the second oldest institution of management education on the West Coast. The school offers bachelors, masters, and doctoral degrees. The National Technical Information Service (NTIS) is an agency in the Technology Administration of the United States Department of Commerce that serves as the U.S. government repository for research and development results and for other information produced by and for the government as well as a variety of public and private sources worldwide.

United States Department Of Justice

The United States Department of Justice (DOJ) is a Cabinet department in the United States government designed to enforce the law and defend the interests of the United States according to the law and to ensure fair and impartial administration of justice for all Americans. The United States Attorney General, one of the original members of the cabinet, administers the DOJ.
Duties of DOJ are:
  • Responsible for investigating and prosecuting violations of federal laws.
  • Represents the United States in all legal matters, including cases before the Supreme Court.
  • Enforces all immigration laws, provides information, and processes applications for citizenship
  • Maintains the federal prison system, halfway houses, and community programs.
Milton Bennett Medary completed the building in 1935 from a design. Upon Medary's death in 1929, the other partners of his Philadelphia firm Zantzinger Borie and Medary took over the project. On a lot bordered by Constitution and Pennsylvania Avenues and Ninth and Tenth Streets, Northwest, it holds over one million square feet of space. The sculptor C. Paul Jennewein served as overall design consultant for the entire building, contributing more than 50 separate sculptural elements inside and outside.
Various efforts, none entirely successful, have been made to determine the meaning of the Latin motto appearing on the Department of Justice seal, Qui Pro Domina Justitia Sequitur. It is not even known exactly when the original version of the DOJ seals itself was adopted, or when the motto first appeared on the seal. The most authoritative opinion of the DOJ suggests that the motto refers to the Attorney General (and thus to the Department of Justice) "who prosecutes on behalf of justice (or the Lady Justice)".
The building was renamed in honor of former Attorney General Robert F. Kennedy in 2001. It is sometimes referred to as "Main Justice."

If you are renting in any Atlanta apartment here is Atlanta security deposit law for you. This money is deemed to be security for any damage to the premises or non-payment of rent. The security deposit does not relieve the tenant of the duty to pay the last month's rent. It must be returned to the tenant upon vacating the premises, if no damage has been done beyond normal wear and tear and the rent is fully paid. If a landlord fails to return the security deposit promptly, the tenant can sue to recover that portion of the security deposit to which the tenant is entitled.

A landlord leasing residential real estate containing five or more units who receives a security deposit may not withhold any part of that deposit as compensation for property damage unless he furnishes to the tenant, within thirty days of the date the tenant vacates, a statement of damage allegedly caused by the tenant and the estimated or actual cost of repairing or replacing each item on that statement. If no such statement is furnished within 30 days, the landlord must return the security deposit in full within 45 days of the date the tenant vacated. The law is constantly changing and there may be times when the information can change timely and accordingly.

Preparing ahead and managing the bad news about company’s or brand reputation is a key public relations task. Bad news can be anything from a poor quarter that has to be reported to the surprise resignation of a key executive, a product recall or the loss of a significant contract. Bad news is normally a disappointment, a set back, and an occurrence, which will impact on the organization and how it is viewed. It’s something you usually initiate and the disclosure of which is your hands.
Here are some principles to follow in planning how to handle bad news.
  • Assume that if you know, others will also soon know - Always work on the principle that bad news travels faster than good news. Make an assessment of who is likely to know, when is the earliest they are likely to learn - and plan to give the bad news before that time.
  • Determine to tell the truth - There is no substitute for telling the truth. It doesn’t mean that you have to give every detail. Resist every attempt from management to try and take short cuts or give a version that suits some internal agendas. And beware of legal interference.
  • Gather history, facts and opinions - While it’s important to get the news out quickly it’s equally important to take the time to find out whether there has been any story around the issue and what’s been communicated to whom in the past. It’s also important to know who has opinions and perspectives on the issue.
  • Do your messaging - Determine what you are going to say. Then document it and test it within your own organization by playing the devil’s advocate and trying to pick holes in your messaging.
  • Front up, don’t hide - Don’t resort to an announcement by email, and then say that no one is available for further comment. The email, media statement or notice board message should be just the starting point - it’s only the announcement.

The ultimate aim in handling bad news is to do so in a way that protects, and in some instances, enhances your corporate reputation. All organizations face bad news from time-to-time; those that suffer the least from it are those that respond and handle it in a manner that is open, confident and truthful.
